The Will of James HORRY
"Know all Men by these presents that I Joseph PICKER of Navenby in the County of Lincoln Farmer the sole Executor named in the last Will and Testament of James HORRY late of Navenby aforesaid Farmer and Miller deceased not having anyways intermeeddled in the Goods Chattels and Credits of the said deceased do renounce and expressly refuse to take upon myself the burthen of the execution of the said Will and consent and agree that the same may be committed and granted unto Elizabeth HORRRY the Widow and residuary Legatee named therein and that this renunciation may have its due effect in Law I do by these Presents nominate constitute and appoint John HAYWARD of the City of Lincoln Notary Public and one of the Procurators General of the Consistory Court of Lincoln to be my true and lawful Proctor for me and in my name to appear before any competent Judge in this behalf and exhibit this my renunciation and pray and procure the same to be admitted and enacted and generally to do whatever is or shall be necessary in and concerning the premises and and what my said Proctor shall lawfully do herein I promise to ratify and confirm In Witness whereof I have hereunto set my hand and seal this Seventeenth day of February in the Year of or Lord One thousand eight hundred and thirty seven. This is the last Will and Testament of me James HORRY of Navenby in the County of Lincoln Farmer and Miller, First I give and Devise all these my Messuages tenements and Dwelling house and all and Singular my Freehold Lands and Lands and Messuages and Tenements held by Lease for years of the Dean and Chapter of Lincoln in the said Parish of Navenby or elsewhere unto and for the Absolute use of my Dear Wife Elizabeth HORRY for the term of her natural life Subject to the said terms as shall be hereinafter expressed and Declared.
(That is to Say) All My Freehold Lands Situate and being in Navenby Leasehold Lands, household furniture, plate and every Appurtenance and requisites thereto belonging, Dwelling house Messuages and Tenements (except what shall be herein after exxpressed and Declared otherwise I give unto my said Wife Elizabeth and her Assigns for her Absolute use and benefit and to bring up maintain and educate my Children as shall be hereinafter mentioned) That is to say, my Daughter Elizabeth, my Son Henry, my Daughter Susanna, and Sarah, my Son John, my Daughter Emma, Deborah and Caroline, and my Son George, and at the Decease of this my said Wife Elizabeth, the Said Property to be equally Divided amongst them share and share alike in equal proportion , And also I Will and Direct that the said Lands Messuages and Tenements at the Decease of this my said Wife Elizabeth be sold for the best price or prices that can be had for the said Lands or tenements by my Trustee or his Executors administrators or assigns for the benefit of these my said Children as hereinbefore expressed and Declared, and all these my said Children as shall have attained the age of Twenty one years to receive their their said shares, and those thaat have not attained that age to be under the Care and management of the sad Trustee as I shall hereinafter Nominate and appoint until they attain the age of Twenty one years, Also I give and Bequeath unto my Son James HORRY all that my Wind Mill now standing in the Parish of Boothby Graffoe with all and every requisite belonging thereto, also all Weights, Measures, Tacklings, Flourbins Belonging the flour shop with weights and measures thereto belongng, sacks and small bags.
Also I give and bequeath unto my said Son JAMES the Sum of Fifty pounds to be paid him when he attain the Age of twentyone years in good and Lawful money of Great Britain.
Also to take Possession of the said Mill and other requisites bequeathed unto him at the Age of Twentyone years
Also I will and Direct that my said Wife Elizabeth have possession of the said Mill and requisites belonging thereto until my said Son James arrive at the Age of twenty one years for the Absolute use and Benefit of her and my other children hereinbefore mentioned,
Also I will and Direct that my said Son James have the said Mill and other requisites and legacy bequeathed unto him for his portion, and not to receive any share of that Property Bequeathed unto my said Wife and other children, and in case thiiis my Son James should be deceased before he arrive at the Age of twenty one years, the Said mill and requisites hereinbefore expressed and Declared, I will and Direct to be Bequeathed unto my Son Henry HORRY when he attains the age of twenty one years,
Also the said Fifty pounds Bequeathed to my son James to be given to my son Henry and he the said Henry HORRY not to receive any other portion or share of the said Property bequeathed to my said Wife and other Children if in case it should so happen he fall the Property bequeathed unto my said Son James.
Also I will and Direct that Mr Joseph PICKER Farmer of the said Parish of Navenby be Sole Trustee and Guardian for this my said Wife and Children and he said the said Joseph PICKER or his Executors and Administrators together With my said Wife Elizabeth have the sole care and management of these my said Children herein before mentioned.
All the rest residue and remainder of my Personal Estate whatsoever and wheresoever and of what nature and kind soever, Subject to the payment of all my just Debts Funeral Expenses and the Expenses of Proving this my Will.
I give and Bequeath unto my said Wife Elizabeth fo the Absolute Use and and (sic) Benefit of her and her Children as hereinbefore expressed and Declared
And lastly I do hereby Nominate Constitute and Appoint the said Mr Joseph PICKER my said Trustee Sole Executor of this my last Will and Testament
